These Terms of Sale (“Terms of Sale”, “Purchase Terms”, “Sale Terms”) govern all purchases made on shop.pingshopping.com (“Shop”, “Store”, “we”, “us”, “our”), including orders of digital products, physical products, and print-on-demand (POD) items, for customers worldwide.

By placing an order on shop.pingshopping.com, you (“you”, “customer”, “buyer”, “user”) agree to be bound by these Terms of Sale.

These Terms of Sale work together with:

If there is any conflict between these Terms of Sale and the master Terms & Conditions, these Terms of Sale will govern purchases, while the master Terms govern general website usage.

1. Scope of These Terms

1.1 These Terms of Sale apply only to transactions and orders placed through shop.pingshopping.com.

1.2 They cover all product categories offered on the Shop, including but not limited to:

  • Digital products (eBooks, guides, templates, downloads, etc.)
  • Physical products (standard manufactured items)
  • Print-on-demand (POD) items made or printed after an order is placed.

1.3 Accessing and browsing the Shop is also subject to the master Terms & Conditions on Pingshopping.com.

2. Eligibility to Purchase

By placing an order, you confirm that:

  • You are legally capable of entering into a binding contract under the laws of your country of residence.
  • You are at least 18 years old (or the age of majority in your jurisdiction), or you are placing the order under the supervision and consent of a parent/legal guardian.
  • The information you supply is truthful, accurate, and complete.

We reserve the right to refuse or cancel orders at any time if we suspect fraud, misuse, legal risk, or violation of these terms.

3. Product Information & Availability

3.1 We make reasonable efforts to ensure that product descriptions, images, specifications, pricing, and availability shown on the Shop are researchful, valid, accurate and up to date.

3.2 However, you acknowledge that:

  • Actual colors or appearances may vary slightly due to screen/device display differences.
  • Sizes, patterns, or finishing of POD or handmade items may vary slightly from mock-ups or sample images.
  • Product availability is subject to stock levels, supplier capacity, and third-party fulfillment constraints, and may change without notice.

3.3 We reserve the right to:

  • Modify or discontinue products
  • Limit quantities
  • Restrict sales to certain countries or regions.

4. Order Process & Formation of Contract

4.1 Placing an order on Shop.PingShopping.com is an offer by you to purchase the selected products under these Terms of Sale.

4.2 An order is considered accepted, and the contract formed only when:

  • Your payment is successfully authorized and captured; and
  • We send you an order confirmation email or make the order status available in your account/dashboard.

4.3 We may, before or after confirmation, cancel any order (in whole or part) if:

  • Payment cannot be processed or verified
  • We suspect fraud or unauthorized use
  • Product is unavailable, discontinued, or mis-listed
  • Shipping to your address is not possible or is restricted
  • There are obvious errors in pricing, product description, etc.

In such cases, any amount paid for the cancelled portion will be refunded in accordance with our Refund Policy.

5. Pricing, Taxes & Errors

5.1 All prices shown on the Shop are indicated in a supported currency and may change at any time without prior notice.

5.2 Prices may or may not include applicable taxes depending on your location and local law. Additional charges such as VAT/GST, import duties, customs fees, and brokerage costs may be collected by authorities or carriers and are your responsibility (see Shipping Policy and Payment Policy).

5.3 While we try to ensure accuracy, pricing or information errors may occur. If we discover a price or listing error after you place an order, we may:

  • Cancel the order and refund any amount paid; or
  • Inform you and give you the option to confirm the order at the corrected price or cancel it.

We are not obligated to fulfil orders at incorrect prices.

6. Payment Terms

6.1 You must pay the full amount for products, including any applicable taxes and shipping fees, at the time of placing the order, using one of the accepted payment methods defined in our Payment Policy.

6.2 By providing payment information, you confirm that you are authorized to use the selected method and that the information is accurate.

6.3 Orders will not be processed until payment has been successfully authorized and captured.

6.4 All payments are subject to our Payment Policy, including rules for:

  • Currency conversion
  • Payment failures or delays
  • Refunds to the original payment method
  • Chargebacks and disputes

7. Shipping, Delivery & Risk of Loss

7.1 Shipping and delivery of physical and POD products are governed by our Shipping & Delivery Policy, which forms part of these Terms of Sale.

7.2 Risk of loss and damage:

  • For physical and POD items, risk passes to you upon delivery to the address you provided or confirmation of delivery by the carrier.
  • For digital products, access is provided via link or account access, and risk passes once the download or access is made available.

7.3 We cannot guarantee exact delivery dates. Estimated delivery times are guidelines only and are not contractual guarantees.

7.4 We are not responsible for:

  • Delays caused by customs, carriers, strikes, emergencies, or events beyond our reasonable control
  • Non-delivery caused by incorrect address information or failure to collect orders

8. Digital Products – License & Use

8.1 When you purchase a digital product (such as an eBook, template, workbook, or other downloadable content), you are purchasing a license to access and use that content for your personal, non-transferable, non-exclusive use, subject to these Terms and any license terms stated on the product page.

8.2 You may not:

  • Share, resell, redistribute, upload or publish the digital product to other sites or platforms.
  • Claim the digital product as your own intellectual property.
  • Use the digital product to create directly competing products for resale (unless the license explicitly allows it)

8.3 Digital products are considered delivered and consumed once access or download is made available. They are generally non-refundable and non-cancellable, except as stated in the Refund, Return & Cancellation Policy (e.g., technical fault, duplicate payment, non-delivery).

9. Print-on-Demand (POD) & Customized Items

9.1 Print-on-demand and customized products are made specially for your order and cannot usually be resold.

9.2 Due to the custom nature:

  • Orders for POD/custom items are non-cancellable once production begins.
  • Returns and refunds are generally only allowed in cases of:
    • Manufacturing defects
    • Damage in transit
    • Incorrect item or print compared to the order confirmation

9.3 Slight differences in color, alignment, or print appearance compared to mock-ups or screen previews do not constitute defects.

10. Returns, Refunds & Cancellations

10.1 Our policies regarding returns, refunds, partial refunds, and cancellations are fully described in our separate Refund, Return & Cancellation Policy, which is incorporated by reference into these Terms of Sale.

10.2 In summary (without overriding that policy):

  • Digital products are generally non-refundable after delivery, except for rare technical or duplicate issues.
  • Physical & POD products may be eligible for refund or replacement in cases such as wrong item, defective or major damage, subject to evidence and reporting timelines.
  • Cancellations may be possible only before production or shipping, depending on the status.

10.3 You agree to review and accept the Refund, Return & Cancellation Policy before placing an order.

11. Prohibited Uses & Order Abuse

You agree not to:

  • Place false, speculative or fraudulent orders
  • Use false identities or impersonate others
  • Abuse coupons, promotions, or refund policies
  • Attempt to reverse engineer, scrape, or misuse our systems or product content
  • Resell our products or use them for illegal or unauthorized purposes.

We may refuse service, block accounts, cancel orders, or take legal action if we detect abuse or malicious activity.

12. Limitation of Liability (Sales Context)

12.1 To the fullest extent permitted by law, PingShopping and its team shall not be liable for:

  • Indirect, incidental, special, consequential or punitive damages
  • Loss of income, profit, savings, data, or business opportunities
  • Issues arising from third-party carriers, payment gateways, customs, or manufacturers

12.2 Our total aggregate liability in connection with any order will not exceed the amount you actually paid for the specific product(s) giving rise to the claim.

12.3 Nothing in these Terms of Sale excludes or limits liability where such limitation is prohibited by applicable law (for example, certain consumer rights).

13. Governing Law & Dispute Resolution

13.1 These Terms of Sale shall be governed by and construed in accordance with the laws of India, without regard to conflict of laws principles.

13.2 Subject to any non-waivable consumer rights you may have in your country of residence, you agree that any disputes or claims relating to purchases from shop.pingshopping.com shall be subject to the jurisdiction of the competent courts in Tripura, India.

13.3 Where required by local law, you may also have the right to seek dispute resolution through consumer protection authorities or alternative dispute resolution bodies in your country.

14. Changes to These Terms of Sale

We reserve the right to revise or update these Terms of Sale from time to time. The updated version will be posted on this page with a new “Last Updated” date.

Your continued use of the Shop and placement of orders after any revision signifies your acceptance of the updated Terms of Sale.
